In early January, President Joe Biden’s administration decided to expand the controversial health regulation, known as Title 42, to allow hot cross-border evacuations of people from Nicaragua, Cuba and Haiti.

Along with greater restrictions on asylum at the border, the Joe Biden administration also created a humanitarian admissions program for people from Cuba, Haiti, Nicaragua and Venezuela.

As of March 31, 55,000 Cubans, Nicaraguans and Haitians had received travel authorization, according to data from a Department of Homeland Security official. For Venezuela, more than 40,000 were recognized from October to March.

“Since the President’s announcement in January, apprehensions at Southwest border ports of entry have decreased dramatically. The successful use of these processes clearly demonstrates that non-citizens prefer to use a safe, legal and orderly route to the United States rather than place their lives in the hands of ruthless smugglers.”

The Biden administration’s use of Title 42 has been widely criticized by human rights organizations and some members of the Democratic Party.

The Biden administration has defended itself against criticism of its use of Title 42, confirming that the regulation will continue to be used as ordered by the Supreme Court.

The rule, which dates back to former Republican President Donald Trump (2017-2021), has allowed more than 2.5 million migrants to be deported since it took effect in 2020, according to data from the International Rescue Committee.

Apprehensions of immigrants trying to cross the U.S. southern border irregularly dropped 96% in the first two months of the year, according to figures from the Department of Homeland Security.

Arrests fell from an average of 1,231 in early January to an average of 46 in late February, the lowest level since 2021 after Cubans, Haitians, Nicaraguans and Venezuelans were arrested in January and February of this year.

“The Biden-Harris administration’s border control measures combine secure, orderly and legal processes to reduce irregular migration,” the source said.
